Dear Property Owner(s):

With the election of a new Board of Directors, and subsequently, new officers and a new Architectural Control Committee (ACC), all requests for improvements should be submitted according to these instructions rather than the address reflected in your copy of the Declaration of Covenants, Conditions and Restrictions for Shady Oaks Estates, or as may have been stated in previous communiqués.

Per the Landscaping Guidelines issued by the ACC on 06/18/2009, any and all improvements utilizing “hardscape” must have prior written approval by the ACC. Landscape improvement projects not utilizing “hardscape” do not require ACC review/approval.

As defined in the Declarations, “Improvement” shall mean every structure and all appurtenances thereto of every type and kind, including but not limited to buildings, outbuildings, storage sheds, patios, tennis courts, swimming pools, garages, storage buildings, fences, screening walls, retaining walls, stairs, decks, landscaping, poles, signs, exterior air conditioning, water softener fixtures or equipment, poles, pumps, wells, tanks, reservoirs, pipes, lines, meters, antennas, towers, and any facilities used in connection with water, sewer, gas, electric, telephone, regular or cable television, or other utilities.” Per the Landscaping Guidelines on 06/18/2009, “hardscape or hardscaping includes, but is not limited to, inanimate elements of landscaping, especially any masonry work or wood work. For instance, stone walls, concrete, brick or tile patios, wood decks or arbors, water features, outdoor fireplaces or fire pits, would all be considered hardscape.”

All requests to the ACC should reflect the scope of the project which includes plans and specifications. You may mail, hand deliver or submit your plans electronically to the Chairperson of the ACC.
